lochenjons 09-11-2006, 08:07 PM So by my friends house there's all these dirt tails and open areas and stuff. And we decided to go for a little wheelin. But apparently its a bunch of different peoples property, rich people to. Anyway a bunch of them called the cops and they called my house a little while ago and it looks like reckless driving, driving off road, trespassing, and vandalism to property. Theres probably nothing i can do and I dont know yet how bad it is, but it sure isnt looking good

Just appologize to them go to the peoples houses man. See if the charges can be dropped. Offer to repair the damage

I talked to one guy as we were leaving that day that threatened to call the police, but he seemed alright about it. The thing is a ton of people called in. the worst neighborhood ever man. and we were only out there for like 10 min

lochenjons 09-11-2006, 08:41 PM haha even though like tons of people all gave the same license plate number. the guy that talked to us said he took pics too but i dont beleive him. actaully theres a 74 around here with the same paint job. maybe i can blame it on him. Actaully Ill just say I didn't know it was people's porperty and i thought it was public and didn't cause really too much damage and that I'll help fix it
ceanern 09-11-2006, 09:07 PM Is there any posted signs? Say it is private property? Also Was it muddy or dry out? Doesn't really tear much up if it is dry. Unless ya were intentionally spinning tires.
lochenjons 09-11-2006, 09:11 PM There were some signs but I cant remeber if there were by where we were. It was dry, we didnt even tear it up or anyhting. In one place yeah, up this steep hill in this field which turns out to be someones "yard". I wouldnt be surprised if nothing happens to me but still its got me worried. Especially cause I just got my license back after being suspended like a month ago
swartlkk 09-11-2006, 09:30 PM I would talk with the owners of the property and ask if you can repair the damage done without charges being filed. If they are pricks about it...see below.
Ok, I'll run down through the things you mentioned:
reckless driving - I don't believe that the cop can issue this ticket without witnessing the incident itself. This cannot be charged by a land owner. If it does get issued, it will probably become a he-said, she-said thing and will be dropped in most courts.
driving off road - is this a ticket? When was it made illegal?...
trespassing - Can be charged by the land owner, but burden of proof is on them. If there are no posted signs, is it trespassing? How are you to know where their land stops and someone elses starts...
vandalism to property - Can be charged by the land owner. Well, gotcha there, but again...deny it and ask for proof.
ceanern 09-11-2006, 10:17 PM It is illegal to go off-roading in Virginia. They consider it wreckless driving. and from what i was told they will arrest you on the spot and impound your vehicle.
DetroitMuscle 09-11-2006, 10:56 PM Even if no signs were posted on the property,if the property corners were marked ( sticks with flourescent ribbon on them) its still tresspassing because it is a visible marker BUT there cant be others around it for marked utilities SO im sure you didnt notice them but its a HEADS UP to anyone who thinks no one owns the land. Keep an eye out for them when you are out on the trails, Charges will stand if they are in place.
Id go apologize let them know you didnt know and were going off the direction of a resident of the neighborhood, they can afford to pursue but most will think " no harm no foul" in the end IF you go to them, the sooner the better.

ceanern 09-11-2006, 11:43 PM Chance are there isn't even any post marking those parts. 90% of the time owners remove them or let stuff grow up around it so it isn't visible.
lochenjons 09-11-2006, 11:59 PM Haha the one guy that got mad at us i made up the dumbest excuses. First i said i was leaving then i said i had to turn around. then he was like "why didnt you just make a u turn??" and i said i couldnt turn that sharp. Then I said i couldnt find my way out.
96Blaze4.3 09-13-2006, 09:59 AM In Tn if the sign say's POSTED NO TRESPASSING then you can get in alot of **** , but if it just says NO TRESPASSING then you are fine , not **** will happen . I learn alot from Coonhunting and having freinds that are gamewardens and a cop for a dad .
My fav law is ( Dogs can't read)..
flowmasta 09-13-2006, 10:41 AM well anyway i agree with swarts initial assessment.....an officer can only give u a ticket there on the spot for any infractions of wreckless driving, speeding or w/e.......matter of fact if the officer does not turn on his lights...and u see him pull behind u, you can pull over and get out of the car fast enough....all before he turns on his lights and he cant legally give u a ticket because he failed to pull you over while u were driving your vehichle.....at least this is what im told by friends who avoided tickets this way......about the only thing they have on you is trespassing but if they have no concrete evidence it was you....they can cry wolf till they are blue in the face but it wont hold up in court......cuz if they just say i saw you doing this....your defence could be...they just dont like me or they have something against me and they are just making **** up.....and them having no solid evidence it was you....have no defense...................any1 else agree?
lochenjons 09-13-2006, 06:12 PM Yeah it doesnt look like anything too bad is gonna happen. I just hope the dmv doesnt send me somehting or do anything, cause that I cant do anything about and they never send anything right away its always months afterwards

lochenjons 09-13-2006, 10:22 PM Well, thats what id like to think but i crashed my last car into a guard rail once going like 55 mph on the freeway (it barely had brakes go figure, i just got it so i didnt have time to fix it). I didnt cause any damage or anything and the police escorted me off, but then i got a point on my license and all this stuff. but yeah thats an accident so its probably different. but then on the police report they said i was going 65+ and unsafe for conditions (it was raining pretty hard). but they were full of crap cause i told them 50-55, the car could barely go 60. I should have fought it but it all impossible having to deal with the dmv
ceanern 09-13-2006, 10:58 PM Yeah. the police filed a report claiming unsafe driving. here most of it is he said she said. and most of it has to be seen. the only one you could have a problem with is the trespassing which there isn't really anything points wise you could get with that cause it isn't a moving violation to trespass you may have been in a vehicle.

Damn that would be horrible, Here in colorado there are hundreds of Tails to wheel and they are all numberd FS roads.
