Default Opening a smashed tailgate

I was recently the victim of vehicular assault (not wanting to go into it too much here, but if you're interested, you can read about it here, close to the bottom of the first page and continuing on the second).

Anyway, in the crash, Neko's tailgate was smashed in, and upon trying to open it, nothing happened. As of right now, the whole thing is bent inward. I turned the latch as hard as I could and pulled as hard as I could, but it wouldn't even budge. I have to get it off to replace it, and my phone charger is pinched in it too, so my phone is dead. How do I get it open? I can't pry on it because the tailgate and back window are the only things broken, and prying would dent and scratch up the parts that I don't need to replace.

Btw, insurance is not covering this.

How can I get it open?

Well considering the tailgate is done for... I'd say have at it with a sawzall, cut a section out of the middle and then you should be able to jimmy it off.

I agree with oktain. Just make sure you get the long metal cutting saw blade.

Why isnt insurance covering that? Call them directly and get a traffic lawyer now.

Irv, it's a complicated situation... It involves corrupt cops, so they say if I try to file a claim, I'll be locked up.

Have you tried taking the trim panel off from the inside and get your self a pair of channel lock pliers to open it?

No, I was told you couldn't pull the panel off with it closed; also, the glass is everywhere, so I can't get back there anyway. I can be sure to try that before cutting it up with a saw, though.
